We design, build, host, and maintain websites for plumbing businesses in Australia. The scope of work for each client is determined by the pricing plan selected at the time of purchase and any additional written agreement between us.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business entity you represent.

3. Account & Client Responsibilities

  • You are responsible for providing accurate business information, content, and materials needed to build your website.
  • You must not use our Services for any unlawful purpose or in a way that violates any applicable Australian law or regulation.
  • You are responsible for maintaining the confidentiality of any account credentials we provide.

4. Fees & Payment

  • Pricing is as displayed on our website at the time of purchase. All prices are in Australian Dollars (AUD) and inclusive of GST where applicable.
  • Subscriptions renew annually unless cancelled before the renewal date.
  • We reserve the right to change pricing with at least 30 days' written notice. Existing subscriptions remain at their current rate until the next renewal.

5. Intellectual Property

  • All website designs, code, templates, and proprietary tools remain our intellectual property unless explicitly transferred in writing.
  • Content you provide (logos, photos, text) remains your property. By providing it, you grant us a licence to use it solely for delivering the Services.
  • Depending on your plan, our attribution mark may appear on your website.

6. Limitation of Liability

To the maximum extent permitted by Australian law, including the Australian Consumer Law:

  • Our total aggregate liability for any claim arising out of or relating to these Terms or the Services is limited to the amount you paid us in the 12 months preceding the claim.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, regardless of whether we were advised of the possibility of such damages.
  • We do not guarantee any specific business results, search engine rankings, lead generation, or revenue outcomes from using our Services.
  • We are not responsible for losses caused by circumstances beyond our reasonable control, including but not limited to third-party service outages, internet disruptions, or force majeure events.

7. Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free from harmful components.

8. Indemnification

You agree to indemnify, defend, and hold harmless Web Design for Plumbers, its owners, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Services, your content, or your breach of these Terms.

9. Termination

  • Either party may terminate the Services by providing written notice.

  • Upon termination, your website will be taken offline. We are not obligated to retain your data after termination.
  • Fees already paid are non-refundable unless otherwise required by Australian Consumer Law.

Our Services may integrate with or rely on third-party tools and platforms (e.g., hosting providers, analytics services, payment processors). We are not responsible for the availability, accuracy, or practices of any third-party service. Your use of such services is subject to their own terms and policies.

11. Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia. Both parties agree to attempt to resolve disputes through good-faith negotiation before commencing legal proceedings.

13. Changes to These Terms
